These Terms of Service ("Terms") govern your use of the Lead Alignment website and services.

1. About Lead Alignment

Lead Alignment LLC ("Lead Alignment," "we," "us," or "our") provides lead generation, digital advertising, marketing, and related services to businesses, including epoxy flooring contractors and other home service businesses.

Our services may include advertising campaign management, lead generation, campaign strategy, marketing consultation, landing pages, lead forms, tracking, reporting, and related services.

2. Eligibility

You must be legally capable of entering into a binding agreement to use our services.

By using our services, you represent that the information you provide to us is accurate and that you have authority to act on behalf of any business you represent.

3. Services

The specific services provided by Lead Alignment will depend on the agreement, proposal, invoice, or service plan applicable to your account.

We reserve the right to modify, improve, suspend, or discontinue portions of our services when reasonably necessary.

4. No Guarantee of Results

Lead generation and advertising results depend on numerous factors outside our control.

These factors may include advertising budgets, market conditions, competition, geographic location, offer quality, pricing, sales processes, response times, seasonality, website performance, customer demand, and the actions of third-party advertising platforms.

Accordingly, Lead Alignment does not guarantee a specific number of leads, appointments, sales, revenue, return on advertising spend, or other financial result unless expressly stated in a written agreement.

5. Advertising Platforms

Our services may rely on third-party platforms such as Meta, Google, or other advertising networks.

Third-party platforms may change their policies, algorithms, pricing, targeting capabilities, approval processes, availability, or functionality at any time.

Lead Alignment is not responsible for actions, restrictions, outages, suspensions, policy changes, or decisions made by third-party platforms.

6. Client Responsibilities

Clients are responsible for:

Providing accurate business information

Providing timely access to required accounts and assets

Reviewing and approving advertising materials when requested

Responding promptly to leads

Providing accurate pricing and service information

Complying with applicable laws and industry requirements

Maintaining appropriate licensing and insurance where required

Handling customer inquiries and sales opportunities professionally

Lead Alignment is not responsible for lost opportunities resulting from a client's failure to respond to or properly handle leads.

7. Lead Quality

Lead Alignment makes reasonable efforts to generate leads according to the campaign criteria agreed upon with the client.

However, Lead Alignment does not guarantee that every lead will:

Answer the phone

Respond to follow-up

Purchase services

Meet the client's preferred budget

Be ready to purchase immediately

Provide accurate information

Ultimately become a customer

Lead quality may vary based on market conditions and other factors.

8. Payments and Fees

Fees, advertising budgets, payment schedules, and cancellation terms will be established in the applicable proposal, agreement, invoice, or service plan.

Unless otherwise stated in writing, advertising spend paid to third-party advertising platforms is separate from Lead Alignment's service fees.

Clients are responsible for paying all undisputed amounts when due.

9. Refunds and Cancellations

Any refund or cancellation rights will be governed by the applicable written agreement or service plan.

Unless expressly stated otherwise, advertising spend already incurred with third-party platforms is non-refundable by Lead Alignment.

10. Intellectual Property

Unless otherwise agreed in writing, Lead Alignment retains ownership of its proprietary systems, strategies, processes, templates, software, methodologies, and other intellectual property.

Clients retain ownership of materials and information they provide to Lead Alignment.

Any client-specific creative assets or deliverables will be governed by the applicable service agreement.

11. Client Content

By providing logos, photographs, videos, trademarks, business information, testimonials, or other materials to Lead Alignment, you represent that you have the necessary rights and permissions for us to use those materials for the purposes of providing the services.

You grant Lead Alignment a limited license to use those materials as reasonably necessary to provide the services.

12. Prohibited Use

You agree not to use our website or services to:

Violate applicable laws or regulations

Provide fraudulent or misleading information

Infringe intellectual property rights

Attempt to gain unauthorized access to systems

Distribute malicious software

Abuse or interfere with our website or services

Engage in deceptive, fraudulent, or unlawful activity

13. Third-Party Services

Our services may integrate with or depend upon third-party services.

Lead Alignment does not control third-party services and is not responsible for their availability, performance, policies, pricing, security, or functionality.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Lead Alignment will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of our website or services.

To the maximum extent permitted by law, Lead Alignment's total liability arising from the services will not exceed the amount paid by the client to Lead Alignment for the services giving rise to the claim during the applicable period specified in the governing agreement.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

15. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Lead Alignment and its officers, employees, contractors, and representatives from claims, damages, liabilities, costs, and expenses arising from:

Your violation of these Terms

Your unlawful use of our services

Your violation of third-party rights

Content or information you provide to us

Your products, services, representations, or business practices

16. Disclaimer

Our website and services are provided on an "as is" and "as available" basis to the maximum extent permitted by law.

We do not warrant that our website or services will always be available, uninterrupted, error-free, or produce a particular business outcome.

17. Privacy
